This Privacy Policy describes how Clearwell AI, owned and operated by Industrial Compute LLC, a New York limited liability company (“Company,” “we,” “our,” or “us”), collects, uses, discloses, and safeguards information when you access or use our platform, website, trial services, marketing materials, or any related services (collectively, the “Services”). By using the Services, you acknowledge and agree to the practices described herein.
1. Scope and Applicability
This Privacy Policy applies to all users of the Services, including visitors to our website (clearwell.ai), individuals who interact with marketing materials or promotional content, users of trial or evaluation accounts, and subscribers to our platform. Separate enterprise agreements may contain additional or superseding data privacy terms; in the event of a conflict between this Privacy Policy and a signed enterprise agreement, the enterprise agreement shall control.
2. Information We Collect
2.1 Account and Contact Information. Personal identification data (name, email address, phone number); professional details (company name, job title, department); and account credentials and authentication information.
2.2 Operational and Platform Data. Asset information, inspection data, maintenance records, compliance documentation, and all other content submitted to or generated through the platform (“User Content”). This includes data uploaded through bulk import features, documents processed by our automated analysis tools, and outputs generated by the platform based on User Content.
2.3 Marketing and Trial Interaction Data. Information provided through marketing channels, including website forms, trial account registrations, chat interactions on our website, uploaded documents or data submitted during evaluation periods, and communications with our team. Data submitted through marketing channels, trial accounts, or website interactions (“Marketing Data”) is governed by the usage terms in Section 4.3 of this Privacy Policy.
2.4 Technical and Usage Data. Device information, IP addresses, browser details, usage patterns, feature interactions, performance metrics, log files, error reports, and system diagnostics.
3. SMS/Text Messaging
When you provide a phone number for sign-in or authentication, you consent to receive SMS messages for one-time verification codes and account security alerts. Messages are sent only when you initiate sign-in requests. Reply STOP to unsubscribe or HELP for assistance. Contact support@clearwell.ai for additional help. Message and data rates may apply; Clearwell AI is not responsible for carrier charges. Phone numbers and SMS opt-in data are never sold, rented, or shared with third parties for marketing purposes.
4. How We Use Your Information
4.1 Service Provision and Improvement. Deliver, maintain, and improve the platform and Services; process transactions and manage accounts; provide customer and technical support; analyze usage patterns to improve functionality; and develop new features and capabilities.
4.2 Proprietary Technology and Automated Processing. Our platform employs proprietary analytical technology, automated processing systems, and advanced computational methods to analyze User Content and generate insights, reports, health assessments, and recommendations. By submitting User Content to the platform, you acknowledge that such content will be processed by our technology stack, which may include third-party computational infrastructure providers that process data on our behalf and under our contractual control. These providers are bound by confidentiality obligations and are prohibited from using your data for any purpose other than providing services to us.
4.3 Data Usage Rights
Platform Subscribers: We process User Content as necessary to deliver the Services. We may use aggregated, de-identified, or anonymized data derived from User Content for product improvement, analytics, benchmarking, and development of new features and services. Aggregated and anonymized data will not identify you or any individual.
Marketing, Website, and Trial Users: By submitting data through our website, marketing channels, trial accounts, or website chat tools (collectively, “Marketing Data”), you grant Industrial Compute LLC a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, process, reproduce, modify, adapt, analyze, create derivative works from, and otherwise exploit such Marketing Data for any lawful business purpose, including but not limited to: improving our platform and Services; training and refining our analytical models and technology; developing new products, features, and services; creating aggregated datasets, benchmarks, and industry analyses; and marketing, promotional, and demonstration purposes (in de-identified form). This license survives termination of your trial or interaction with our marketing materials.
4.4 Communication and Support. Send service updates, security notices, and administrative messages; respond to inquiries; and send marketing communications (with consent, where required by applicable law).
4.5 Security and Compliance. Protect against fraud, abuse, and security threats; ensure compliance with legal obligations and industry standards; and conduct audits, investigations, and enforce terms of service.
5. Information Sharing and Disclosure
Data Not Sold: Personal information is never sold, rented, or traded to third parties for their direct marketing purposes.
5.1 Service Providers and Infrastructure Partners. We share information with trusted third-party providers that assist with platform operations, including cloud infrastructure providers, computational processing services, payment processors, and analytics services. All service providers are bound by confidentiality agreements and are permitted to use your data only to perform services on our behalf.
5.2 Legal Requirements. We may disclose information to comply with applicable laws, regulations, or legal processes; protect company rights, property, or safety; and respond to government requests and regulatory inquiries.
5.3 Business Transfers. In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred to the acquiring entity, subject to the terms of this Privacy Policy.
6. Data Security and Protection
We maintain enterprise-grade security measures including encryption for data in transit and at rest, multi-factor authentication, role-based access controls, ongoing security review and vulnerability monitoring, and incident response procedures.
Data Retention: Information is retained for as long as necessary to provide Services, comply with legal obligations, resolve disputes, enforce agreements, and fulfill the purposes described in this Privacy Policy, including the data usage rights in Section 4.3. When data is no longer needed for these purposes, it is securely deleted or anonymized at our discretion.
7. Your Privacy Rights and Choices
Subject to applicable law, you may: access, review, and update personal information; request correction of inaccurate or incomplete data; request deletion of personal information (subject to legal requirements, contractual obligations, and our data retention practices); export data in a portable format (for active subscribers only); opt out of marketing communications; and manage notification settings. Requests may be submitted to support@clearwell.ai. Please note that rights to data deletion or export do not apply to aggregated, anonymized, or de-identified data, nor to data for which we have received a license under Section 4.3.
8. International Data Transfers
Data may be processed and stored in countries other than your own. Appropriate safeguards are in place for international transfers, including standard contractual clauses and adequacy decisions where applicable.
9. Changes to This Privacy Policy
We may update this Privacy Policy periodically. Material changes will be communicated through the platform or email. Your continued use of the Services following any changes constitutes acceptance of the updated Privacy Policy.
